ATEX compliance is not optional – it's a legal obligation
Under Decree 3/2003 (FMM–ESzCsM), every operator must carry out an assessment of explosion risks. If flammable material is present, the Explosion Protection Document (EPD) is mandatory.
Authority inspection
The labour-safety authority and disaster management can request the EPD and zone maps at any time. In their absence: an immediate fine and the risk of suspended operation.
Insurance precondition
After an explosion or fire, the insurer may exclude compensation if there was no valid ATEX documentation. A missing EPD is grounds for exclusion.
Worker safety
The explosion protection document is not a bureaucratic obligation, but the technical foundation that protects the lives of the plant's workers.
When to update?
Mandatory on technology or equipment change, and recommended at least every 3 years. An outdated EPD is just as much a risk as a missing one.
